Terms of Service

1. Acceptance of Terms

By creating an account or using WhatBiz you agree to these Terms of Service. If you do not agree, do not use the service. WhatBiz is operated by Degordons Tech Enterprises, Abuja, Nigeria.

2. Description of Service

WhatBiz is a business platform that includes a messaging automation service and a Storefront service. The messaging automation enables businesses to automate customer interactions across WhatsApp Business, Instagram Direct Messages, and Facebook Messenger, including automated reply systems, order collection, payment link generation, broadcast messaging, and comment keyword triggers. The Storefront service provides each business with a public-facing online store at whatbizapp.com/store/{slug} where their customers can browse products, place orders, and pay directly. Both services are managed from the same business dashboard.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the service. One account per business. You may not share your account with others or use the service to impersonate another person or business.

4. Acceptable Use

You may use WhatBiz only for lawful business purposes. You may not use the service to send spam or unsolicited messages, to harass, threaten, or deceive customers, to sell illegal goods or services, to violate Meta Platform Terms for WhatsApp, Instagram, or Facebook, or to circumvent any security measures. We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Meta Platform Compliance

By connecting your WhatsApp Business number, Instagram account, or Facebook Page to WhatBiz, you agree to comply with Meta Platform Terms and WhatsApp Business Policy. You are responsible for ensuring your use of the connected channels complies with Meta policies. WhatBiz is not responsible for account restrictions imposed by Meta for policy violations.

6. TikTok Platform Compliance

By connecting your TikTok account to WhatBiz, you agree to comply with the TikTok Terms of Service and TikTok Developer Policies, in addition to these terms. You are responsible for ensuring your use of TikTok through WhatBiz complies with TikTok policies. WhatBiz accesses TikTok data only through the official TikTok Business API and is not responsible for account restrictions imposed by TikTok for policy violations. You may disconnect your TikTok account at any time from your WhatBiz settings.

6b. Storefront and Customer Orders

When you use the WhatBiz Storefront, your customers place orders and make payments directly through your public store page. You are responsible for fulfilling all orders placed through your storefront, for the accuracy of product listings, pricing, and availability, and for communicating delivery timelines to your customers. WhatBiz facilitates payments through Paystack or bank transfer on your behalf but is not a party to the transaction between you and your customers. You are responsible for handling customer disputes, refunds, and complaints arising from storefront orders. WhatBiz is not liable for losses arising from failed deliveries, incorrect orders, or customer dissatisfaction. Customer personal data collected during storefront checkout (name, phone number, email address, delivery address) is subject to our Privacy Policy.

7. Payment and Billing

WhatBiz Free is free forever within the stated message limits. Paid plans (Pro and Unlimited) are billed monthly in Nigerian Naira. Payments are processed via Paystack. Subscriptions renew automatically unless cancelled. No refunds are provided for partial months. We reserve the right to change pricing with 30 days notice.

8. Message Limits

Free accounts are limited to 1,000 inbound messages per month. Pro accounts are limited to 10,000 messages per month. Unlimited accounts have no message limit. If you exceed your plan limit, automated responses will be paused for the remainder of the billing period. Upgrade at any time to restore service immediately.

9. Data Ownership

You own all data you input into WhatBiz including your products, customers, and order records. WhatBiz does not claim ownership of your business data. You grant WhatBiz a limited licence to process your data solely for the purpose of providing the service. We will not access, use, or share your data except as described in our Privacy Policy.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. We are not liable for losses caused by service downtime, API rate limits imposed by Meta or Paystack, or events outside our reasonable control.

11. Limitation of Liability

WhatBiz is provided as-is. To the maximum extent permitted by law, Degordons Tech Enterprises shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost revenue, lost orders, or customer dissatisfaction resulting from automated responses.

12. Termination

You may cancel your account at any time from your dashboard settings. We may suspend or terminate your account for violation of these terms. Upon termination your data will be deleted within 30 days.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or dashboard announcement. Continued use of WhatBiz after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Abuja, Nigeria.
